Together with our respective Terms of Use, Cookies Notice, and Do-Not-Track Disclosure, this Privacy Policy sets out our practices with respect to your personal information and the rights you have in relation to your personal information.

The data controller of your personal information is Hybe America Inc. The Company will use your information as further explained in this Privacy Policy.
Please read this Privacy Policy carefully to understand the Company’s policies and practices regarding your information and how we collect, process and store it. If you do not agree with the terms of this Privacy Policy, your choice is to not use our Service Platforms. This Privacy Policy may change from time to time (see Changes to Our Privacy Policy). Your continued use of a Service Platform after we make changes to this Privacy Policy is deemed to be an acknowledgment and acceptance (unless affirmative opt-in consent is otherwise required by applicable law) of those changes, so please check this Privacy Policy periodically for updates.
Our Service Platforms are not intended for children under 16 years of age. We do not knowingly collect personal information from children under 16 years of age. If you are under 16 years of age, you must provide parental consent before using our Service Platforms in any manner, including providing any information, registering for accounts, or submitting any audition materials. If you do not provide this parental consent, and you are under 16 years of age, do not use or provide any information on our Service Platforms or through any of their features, register for accounts on the Service Platforms, submit any audition materials, use any of the interactive or public comment features of the Service Platforms, or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn we have collected or received personal information from a person under sixteen (16) years of age without verification of parental consent, we will delete that information. Information We Collect About You and How We Collect It

Information You Provide to Us
The information we collect on or through our Service Platforms may include:
· Information that you provide by filling in forms. This includes information provided at the time of registering to use our Service Platforms, subscribing to our Service Platforms, uploading material to our Service Platforms, including but not limited to audition materials, posting material on our Service Platforms, including your name, address, email address, phone number, date of birth, or copies of formal identity documents. It may also include a video recording or sound recording of you, profile picture, and access to your camera and/or photo library (if you choose to enable these features on your computer or device). We may also ask you for information when you enter a contest or promotion sponsored by us, upload or submit audition material to us, and when you report a problem or ask for help with the Service Platforms;
· Records and copies of your correspondence (including email addresses), if you contact us;
· Your responses to voluntary surveys that we might ask you to complete for research purposes; and,
· We may monitor or record telephone conversations or other communications between you and us.
· You may also provide information to be published or displayed (hereinafter, "posted") on public areas of the Service Platforms, or transmitted to other users of the Service Platforms or third parties (collectively, "User Contributions"). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to certain Service Platform pages, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Service Platforms with whom you may choose to share User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by others.
Information We Collect Through Automatic Data Collection Technologies
As you navigate through and interact with our Service Platforms, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including, but not limited to:
· The Internet protocol (IP) address used to connect your device to the Internet, your login information, browser type and version, time zone setting, operating system, device information (such as the model and version of your device), platform, ID for advertising, and unique device token;
· Details of your visits to our Service Platforms, including traffic data, location data, logs, referral URL, ad data, your browsing history, and other communication data and the resources that you access and use on the Service Platforms; or,
· Information about your use of the Service Platforms, including pages you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and any data you entered into the page during your visit.
We may use your device’s physical location to provide you with personalized location-based services and content. In some instances, you may be permitted to allow or deny such uses and/or sharing of your device’s location, but if you do, we and/or our service partners may not be able to provide you with the applicable personalized services and content.
The information we collect automatically does include personal information, but we may maintain it or associate it with personal information we collect in other ways or that we receive from third parties. We need to collect personal information from you because it helps us to improve our Service Platforms and to deliver a better and more personalized services, including by, but not necessarily limited to, enabling us to:
· Estimate our audience size and usage patterns;
· Store information about your preferences, allowing us to customize our services or Service Platforms according to your individual interests;
· Speed up your searches; and/or
· Recognize you when you return to our Service Platforms.
The technologies we use for this automatic data collection may include:
· Cookies (or browser cookies). A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser. However, if you select this setting, you may be unable to access certain parts of our Service Platforms. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Service Platforms. · Web Beacons. Pages of our Service Platforms may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).
Information We Receive From Other Sources
We work closely with third parties including, for example, our email address and telephone number verification service providers. Specifically, in providing services to you, the Service Platforms incorporate service solutions provided by third-party service providers such as, but not limited to: Google Analytics. We may receive information about you from these and other third parties to verify information you provide to us which helps us to identify suspicious or unusual transactions.
We may also supplement the information we collect with information from other sources, such as publicly available information about your online and offline activity from social media platforms, advertisers, commercially available sources, and information from our affiliates, subsidiaries, and/or business partners.
We allow you to share information with our Social Media Pages or use social media sites to create your account on the Service Platforms or to connect your account with the respective social media site. If you connect your social media account to a Service Platform account, you will share certain personal information from your social media account with us. For example, you will share your name, email address, photo, list of social media contacts, and any other information that may be or you make accessible to us when you connect your social media account to your Service Platforms account.
We may also use plug-ins or other technologies from various social media sites. If you click on a link provided via a social media plug in, you are voluntarily establishing a connection with that respective social media site.
We do not use technologies to collect information about your online activities over time and across third-party websites or other online i.e., behavioral tracking and therefore our Websites do not respond to Do Not Track (DNT) signals. Some third-party sites do keep track of your browsing activities when they serve you content, which enables them to tailor what they present to you. If you are visiting such sites, many modern web browsers allow you to set the DNT signal on your browser so that third parties (particularly advertisers) know you do not want to be tracked. Except as described herein, the Company does not authorize the collection of personal information (PII) for third party use through advertising technologies without separate consent.
Some content or applications, including advertisements, on the Websites are provided by third parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Service Platforms. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.
We do not control these third parties' tracking technologies or how they may be used. If you have any questions about an advertisement or other targeted content, you should contact the responsible provider directly. If you disclose any personal information relating to other people to us, or to our service providers in connection with the Service Platforms, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy.
We use information that we collect about you or that you provide to us, including any personal information:
Functionality of the Service Platforms
· To provide our Service Platforms and their contents to you, such as arranging access to your Service Platform accounts, enabling you to submit or upload audition materials, managing your relationship with us, or customer service.
· To respond to your inquiries, and provide you with information, products, or services that you request from us.

· To provide you with notices about your account, including changes to our terms, conditions, or policies.
· To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

We will engage in these activities to manage our contractual relationship with you and/or to comply with a legal obligation.
Communicating with You
· To send you marketing related emails, with information about our Service Platforms, new products or services, and other news about us.
· To communicate with you by telephone, mail, email, text (SMS) message, instant messaging, or other electronic means, consistent with applicable law. Message and data rates may apply.

We will engage in these activities with your consent or where we have a legitimate interest.
Administration of Contracts

We may use the information we have collected from you to enable us to display advertisements to our advertisers' target audiences. Even though we do not disclose your personal information for these purposes without your consent, if you click on or otherwise interact with an advertisement, the advertiser may assume that you meet its target criteria.
We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

Third party analytics and advertising companies also collect personal information through our Service Platforms. For example, we use Google Analytics on our Service Platforms to help us understand how users interact with our Service Platforms. We will retain your personal information for as long as needed or permitted in light of the purpose(s) for which it was obtained. The criteria used to determine our retention periods include: (i) the length of time we have an ongoing relationship with you and provide services to you; (ii) whether there is a legal obligation to which we are subject; and (iii) whether retention is advisable in light of our legal position (such as in regard to applicable statutes of limitations, litigation, or regulatory investigations).
Please note, however, that this is not an exhaustive list of retention periods. Your personal information may be stored for a longer period using the criteria set forth in the first paragraph of this section, especially points (ii) and (iii).
We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

· Disclosure of Your Information for Third-Party Advertising. If you do not want us to share your personal information with unaffiliated or non-agent third parties for promotional purposes, you can opt-out by adjusting your user preferences in your account profile associated with your submission email address, i.e., your Gmail account, or by sending us an email with your request to hbaprivacy@hybecorp.com.
· Promotional Offers from the Company. If you do not wish to have your contact information used by the Company to promote our own or third parties' products or Service Platforms, you can opt-out by logging into the Service Platform and adjusting your user preferences in your account profile by checking or unchecking the relevant boxes, or by sending us an email stating your request to hbaprivacy@hybecorp.com.
· Marketing-Related Communications from the Company. If you no longer wish to receive marketing-related communications from us, you may opt-out by selecting the ‘unsubscribe’ option in the marketing communication we sent, by sending us a return email asking to be omitted from future email distributions, or by changing your account preferences. This opt-out election does not apply to information provided to the Company as a result of an entry submission, product purchase, service experience, or other transactions.
· Text (SMS) Messages from the Company. If you no longer wish to receive text (SMS) messages from us, you may reply STOP at any time to cancel these messages or opt out by contacting hbaprivacy@hybecorp.com.
· Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers' target-audience preferences, you can opt-out by sending us an email stating your request to hbaprivacy@hybecorp.com. For this opt-out to function, you must have your browser set to accept all browser cookies.
This Privacy Policy does not address, and we are not responsible for, the privacy, information, or other practices of any third parties, including any third party operating any website or service to which the Service Platforms link. The inclusion of a third-party link on the Service Platforms does not imply endorsement of the linked site or service by us or by our affiliates. Additionally, we are not responsible for the information collection, use, disclosure, or security policies or practices of other organizations, such as Facebook, Apple, Google, Microsoft, or any other app developer, app provider, social media platform provider, operating system provider, wireless service provider, or device manufacturer, including with respect to any personal information you disclose to other organizations through or in connection with our Social Media Pages.
By consenting to this Privacy Policy, you are giving us permission to process your personal information specifically for the purposes identified. You may withdraw consent at any time by contacting us at hbaprivacy@hybecorp.com.

You can review and change your personal information by logging into the Service Platforms and visiting your Service Platform account’s profile page.
If you would like to request access to, correct, update, suppress, restrict, or delete any personal information that you have provided to us, object to or opt out of the processing of personal information, or if you would like to request to receive a copy of your personal information for purposes of transmitting it to another company (to the extent these rights are provided to you by applicable law), you may email us at hbaprivacy@hybecorp.com. we will respond to your request consistent with applicable law. For example, we may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
In your request, please make clear what personal information you would like to have changed or whether you would like to have your personal information suppressed from our database. For your protection, we may only implement requests with respect to the personal information associated with the particular email address that you use to send us your request, and we may need to verify your identity before implementing your request. We will try to comply with your request as soon as reasonably practicable.
Please note that we may need to retain certain information for recordkeeping purposes and/or to complete any transactions that you began prior to requesting a change or deletion.
If you delete your User Contributions from the Service Platforms, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other Service Platform users. Access and use of information contributed by you to our Service Platforms, including User Contributions, is governed by our Terms of Service.
Your personal information may be stored and processed in any country where we have facilities or in which we engage service providers, and by using the Service Platforms you understand that your information will be transferred to countries outside of your country of residence, including the United States, which may have data protection rules that are different from those of your country. In certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities in those other countries may be entitled to access your personal information. Some countries outside of the European Economic Area (the “EEA”), the UK and Switzerland are recognized by the European Commission, the UK government or the Federal Data Protection and Information Commissioner or the Federal Council (as applicable), as providing an adequate level of data protection according to EEA standards. As described above, all our users have control over their information and can directly edit or delete information from their account and limit what data we process. If you are located in certain regions, including the European Union, you may have additional rights such as those listed below:

· The right to limit the processing of your personal information;
· The right to the portability of your personal information;

· Oregon residents can request a list of the specific third parties, other than natural persons, to which personal information has been disclosed, if applicable.
You also have the right to not be discriminated against for exercising your rights. The laws of the states above also provide residents the right to opt out of “sales” of your information and “sharing/processing of information for targeted advertising.”
Certain information may be exempt from the requests above under applicable law. For example, we need to retain certain information in order to provide our services to you. We also need to take reasonable steps to verify your identity before responding to a request. If you are an authorized agent submitting a request on a user’s behalf (where permitted), we may require proof of your written authorization before processing the request. Residents of Colorado, Connecticut, Oregon, Texas, and Virginia have the right to appeal our decision to deny your request.

Additional Information for Users in California
In addition to the rights described above, consumers residing in California are afforded the right to certain additional information with respect to their personal information under the California Consumer Privacy Act of 2018 and California Privacy Rights Act of 2020 (collectively, the “CPRA”). If you are a California resident, this section applies to you.
Our collection and use of personal information: We collect the following categories of personal information: identifiers (such as your username, the email address you used to sign up, and your phone number if you’ve chosen to provide it); commercial information (a record of what you’ve bought from us, if anything); financial data (your history of purchases from us); internet or other network information (how you interact with the Service Platforms); location information (because your IP address may indicate your general location); inference data about you (for example, what content you may be interested in); and other information that identifies or can be reasonably associated with you. Disclosure of personal information: We may disclose your personal information to third parties as described in the How We Disclose Your Information section of this Privacy Policy. We disclose the categories of personal information mentioned in that section for business or commercial purposes.
No sale or “share” of personal information: The CPRA sets forth certain obligations for businesses that sell or “share” personal information. We do not sell or share the personal information of our users as those terms are defined in the CPRA. We do disclose certain information as outlined in the How We Disclose Your Information section of this Privacy Policy and you can make choices with respect to your information as outlined in this Privacy Policy.
We retain personal information as described in the How Long Do We Keep Your Information section of this Privacy Policy.
California’s “Shine the Light” law gives residents of California the right under certain circumstances to request information from us regarding the manner in which we share certain categories of personal information (as defined in the Shine the Light law) with third parties, as defined under applicable law, for their direct marketing purposes.
Information for Users in the EEA, United Kingdom, and Switzerland
All our users have control over their information and can directly edit or delete information from their account and limit what data we process. In addition to these rights, users residing in the European Economic Area (EEA), United Kingdom (UK), and Switzerland are afforded additional rights under the General Data Protection Regulation (GDPR), the UK Data Protection Act 2018, and the Swiss Federal Act on Data Protection (FADP). For example, you can request a copy of your data, ask to have it deleted, and adjust your privacy settings right in the Service Platforms. Data Controller: If you reside in the European Economic Area (“EEA”) or United Kingdom, the “data controller” of your personal information collected the Company’s Websites is as provided in this Privacy Policy.
Exercising your rights: All our users have control over their information and can directly edit or delete information from their account and limit what data we process.
